Terms and Conditions of Sale

These Terms and Conditions of Sale are entered into between:

  • The company BUDOFIGHT, SARL with a share capital of €500,000, whose registered office is located at 220 rue Saint Jacques in Paris (75005), registered with the Paris Trade and Companies Register under number 553 592 044 (hereinafter referred to as "the company or the site")
  • And any person making a purchase (hereinafter referred to as "the customer or the user") on the website www.budo-fight.com.

All orders placed through www.budo-fight.com are subject without reservation to these terms and conditions.
These terms represent the entirety of the mutual commitments between Budo-Fight and the user, who becomes a customer of the company.
 

Article 1: Order

The order process is organized in several steps, which can be summarized as follows:

  • You create your cart with one or more products,
  • You create your account on the site by providing your status (individual, association, company), as well as your contact information,
  • You select a shipping method, the terms and pricing of which are automatically determined by the site based on the products in the cart and the desired shipping address,
  • You make your payment, either online (via CIC) or offline by sending a check (for clubs only) or by making a bank transfer,
  • You receive an email confirming your order, followed by a confirmation of your payment.
     

Article 2: Pricing & Invoicing

The prices displayed on www.budo-fight.com are, by default, shown in euros and incl. VAT.

The prices on the site are independent from those in Budo-Fight stores, unless otherwise stated; the prices displayed on the site apply exclusively to products purchased online.

VAT is applied at the rate in effect at the time the order is placed. Product prices displayed on the site do not include shipping fees unless otherwise stated. ​

  • Invoicing is done at the price in effect at the time of the order.
  • The current VAT rate applied to this catalog is 20%.
  • Photos are non-contractual
     

Article 3: Availability

Our product and price offers remain valid as long as they are visible on the site, except for special promotions whose validity period is specified on the site. The user is invited to check the availability of items for sale on each product page.

In the very rare event of a stock error, i.e., if a product is unavailable after the order has been placed, the customer will be informed of the timeframe in which the product will become available.

If the customer does not wish to wait for the product to become available, or in the event of permanent unavailability, they will be refunded the full price of the product and any shipping fees.
 

Article 4: Shipping

The site offers free shipping for orders over €39 to a pickup point & €59 for home delivery.

These conditions apply to mainland France and Corsica (surface mail) only, for shipments via MONDIAL RELAY OR COLISSIMO.

However, excluded from these rates and automatic calculations are all products that are by nature "very bulky" or "very heavy," for which we must use specific shipping methods: mats, tatami, punching bags weighing over 30 kg including packaging, Bo, all martial arts weapons over 1 m, Makiwara poles, Naginata, referee boards... and more generally, any items for which specific shipping fees are mentioned on the product page.

Likewise, for certain products, not all shipping options are available (for example, some martial arts weapons are available via Colissimo Classic, but not via Colissimo Pickup Points).

All delivery times announced on the site are calculated in business days: preparation and shipping times, as well as carrier delivery times.

Products are delivered to the shipping address provided at the time of order or to the indicated pickup point.

In the event of an exceptional out-of-stock situation, the customer will be notified by email or phone. Budo-Fight will offer you either to delay the shipping of the entire order until the product is restocked, to accept a partial delivery with a refund for the undelivered product(s), or to cancel and refund the entire order amount including shipping fees.

Similarly, in the event of an exceptional delay in preparation or shipping, you will be notified by email or phone and may request a cancellation and refund of the full order amount including shipping fees.

Delivery of bulky items with Schenker:

Upon receipt, please check the condition of the package. If it is damaged or the packaging is compromised, sign with a specific reservation (e.g.: "package crushed," "packaging opened," etc.).

The note "subject to unpacking" is not sufficient. If in doubt, contact us immediately at 02 32 86 05 40 in the presence of the carrier.

Without a specific reservation made at the time of delivery, unfortunately, no claim can be accepted by the carrier for apparent damages.

Be as precise as possible when filling out the address. If there is an error, we will be obliged to charge you the additional shipping fees required by the carrier to modify the delivery (€59 incl. VAT). Pay special attention to the following:

  • If the shipping address is that of a company, store, or office, this must be specified and the name must appear in the address.
  • Be sure to include the name and number of the person who will receive the delivery.
  • Make sure your email address is correct.

Article 5: Satisfaction Guarantee and Return Conditions

Budo-Fight accepts returns, whatever the reason!

All products purchased from the Budo-Fight store can be refunded as store credit and/or exchanged, provided they are returned to us in perfect condition, complete, and in their original packaging. The return request must be made within 30 days of receiving the package. Don’t forget to include your return slip!

Return shipping costs are the sole responsibility of the customer. 

In the event of an exchange (size, color, model, etc.), Budo-Fight will cover the new shipping costs for the first exchange.

Once your package has been sent, please allow 14 business days for it to reach us. As soon as we receive it, we will process your return within 4 business days and a confirmation email will be sent to you. The refund will be made automatically within 5 to 10 days to the same account used to place the order.

Exceptions

This right of return cannot be exercised if the returned items are incomplete, without their original packaging, or damaged. Washed items are neither returned nor exchanged.

Any personalized item, such as embroidered belts or gi, or those subject to specific hygiene measures (groin guard, chest guard, etc.) will not be refunded or exchanged.

For international customers (outside mainland France), returns must be made at your own expense.

Article 6: Warranties

For claims within 31 days from the delivery date, please refer to Article 5 of these terms and conditions (above).

In general, unless otherwise specified, all products sold by Budo-Fight come with a commercial warranty of twelve months from the date of delivery or in-store pickup under normal conditions of use. Excluded from this warranty are all items with one or more zippers, elastics, or hook-and-loop fasteners.

This commercial warranty is limited to the exchange or repair of the product, subject to presentation of proof of purchase by the customer and after inspection of the product by the company.

This warranty does not cover damage resulting from negligence, misuse, or poor maintenance.

This commercial warranty is supplemented by the legal warranty of conformity as provided by law, namely a period of 2 years from the date of delivery or in-store pickup.

More specifically, the customer has two years from the delivery of the goods to report any lack of conformity, and may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L. 211-9 of the French Consumer Code. Additionally, the customer is exempt from providing proof of the existence of the lack of conformity during the six months following delivery. This period will be extended to twenty-four months from March 18, 2016.

Article 7: Retention of Title

Goods remain our property until full payment of the agreed price; judicial settlement or liquidation of the buyer's assets does not alter this clause.
 

Article 8: Governing Law

These general terms and conditions of sale and all transactions relating to the company are governed by French law.
Any dispute will therefore be submitted to the jurisdiction of the French courts. (the customer is free to choose the court of their choice).

Article 9: Payment

Your order is payable at the registered office of Budo-Fight; payment must be made in full at the time of order confirmation, according to the available payment methods.

By credit card via the "CIC" bank

Providing your credit card number online is safe if you do so within a secure process as we offer on our site, having adopted the highest security standards. Payment by credit card is handled by the Ogone group, recognized for its reliability in online transactions. The transaction between you and Ogone is fully encrypted (SSL). The banking information you provide, encrypted on your own computer, never circulates in plain text on the Internet. No one can see or use it without your knowledge. In addition to being encrypted and therefore unreadable, this information is not stored on our servers (which is why you are asked to provide it again for each purchase), thus preventing any issues with potential fraudsters. Also, payment by credit card allows your order to be processed immediately: you benefit from the speed and efficiency of our logistics services.

Through the Scalapay system for all carts starting from €149

Simply select the Scalapay option when choosing your payment method and you will be redirected to the secure Scalapay payment page to confirm your payment.

In the case of online payment (via the bank or via Scalapay), you will receive an email confirming that your payment has been received by our services.

By check

Payment by check is available exclusively for clubs and associations:

After creating your cart, fill in and confirm your contact details, then write your order number on the back of the check and send it to BudoFight, 47 sente du Bois Tison, 76160 Saint-Jacques-sur-Darnétal.

Your order will be processed upon receipt of your payment and you will receive an email confirming the validation of your payment.

However, please note that we reserve a shipping period of 15 to 30 days to ensure the reliability of your payment.

By bank transfer

Bank transfer is another payment method offered by Budo-Fight. Please use the information below to make your transfer. Please note that your order will only be processed upon receipt of your payment, which may take several days (up to 4 business days) due to bank processing times. Your order will be processed upon receipt of your transfer and you will receive an email confirming its validation.

Through two satisfaction surveys designed to measure the quality of service you received throughout your purchase, you can share your personal experience and share it with the online community on the TRUSTPILOT website.

These surveys may be sent to you by TRUSTPILOT or by Budo-Fight, via email following your purchase.

The information collected in these two surveys is subject to automated data processing, for which TRUSTPILOT S.A. is responsible.

Partial responses or failure to respond to one or both satisfaction surveys will not affect the processing of your order.

Article 11: Specific Case of Martial Arts Weapons

Martial arts weapons are prohibited for minors (under 18 years old). They are intended for recreational or sporting use within the practice of Martial Arts.

Payment via the Paypal system is not permitted for the sale of martial arts weapons.

Similarly, some martial arts weapons are available via Colissimo Classic, but not via Colissimo Pickup Points.
